Bankruptcy

Wescott, Dyer, Fitzgerald & Nichols, PA is a Debt Relief Agency. We help people file for bankruptcy relief under the United States Bankruptcy Code. We also help creditors file claims against Bankruptcy Estates.

You can file for bankruptcy yourself or hire an attorney or a petition preparer. An attorney will explain the law as it applies to your situation, and guide you through the filing process to resolution of your case. Although each bankruptcy is unique and the law is complex, many cases are routine and can be resolved fairly quickly. You do not need to hire an attorney to file for bankruptcy, but only an attorney can give you legal advice.

Filing for bankruptcy gives debtors immediate relief from creditor and collection calls, and stays property repossessions and foreclosure proceedings.

Consumer bankruptcies fall under two main categories: Chapter 7 and Chapter 13. In general terms, debtors who are unable to repay any portion of their debt may qualify for Chapter 7 bankruptcy, while debtors with higher income levels will qualify for Chapter 13. Chapter 13 establishes a plan whereby you repay all or a portion of your debts within a term of years, allowing you to keep your home and vehicles in the event you are behind on your mortgage or car payments. Many businesses also qualify for Chapter 7 filing.

Bankruptcy is a collaborative process. The law requires that you fully disclose all your assets and debts. After an initial consultation, Attorney Ambrose will help you determine whether bankruptcy is the right choice for you and will review your financial situation in detail with you to determine the proper course of action for relief.
