<p>Talking on a cell phone while driving isn&#8217;t illegal in New Hampshire, and that behavior alone doesn&#8217;t enable prosecutors to charge someone with negligent homicide, the lawyer for a Franklin woman convicted of killing a pedestrian with her car argued yesterday before the state Supreme Court.</p>
<p>Although prosecutors introduced evidence that Lynn Dion made and received calls in the 37 minutes before she struck and killed Genny Bassett on Central Street in Franklin in June 2009, that doesn&#8217;t make Dion criminally liable for Bassett&#8217;s death, said Dion&#8217;s attorney, Allison Ambrose. Dion was found guilty of negligent homicide last year by a Merrimack County jury.</p>
<p>&#8221;This was a tragic accident,&#8221; Ambrose said during yesterday&#8217;s oral argument, held at Monadnock Regional High School as part of the court&#8217;s &#8221;On the Road&#8221; series. She pointed to a 2009 state Supreme Court ruling that said not all driver inattention is criminal and required that prosecutors prove a defendant engaged in serious blameworthy conduct to bring a negligent homicide charge.</p>
<p>Texting while driving became illegal in New Hampshire in 2010, but talking on the phone in the car is &#8221;a common occurrence,&#8221; Ambrose said. She said drivers in the state had &#8221;no notice . . . that talking on a cell phone can lead to criminal liability.&#8221;</p>
<p>Senior Assistant Attorney General Susan McGinnis said New Hampshire drivers are required to pay attention, avoid pedestrians and use due care while driving &#8211; the reasons the negligent homicide statute exists, she said.</p>
<p>&#8221;The defense wants you to hold that because everyone does something, you can&#8217;t be criminally punished for it,&#8221; McGinnis said. She said Dion, who struck the 36-year-old Bassett and another pedestrian in a lit crosswalk, had a clear view of the road and more than a brief lapse in attention.</p>

<div id="dfp_intext_med_rectangle">&#8221;She hit her brakes after she hit them and at that point she thought maybe a rock had gone through her windshield,&#8221; McGinnis said. &#8221;The jury drew a line here, and the line was entirely reasonable.&#8221;</div>

<p>McGinnis said it didn&#8217;t matter whether the behavior that led prosecutors to charge Dion with negligent homicide was illegal on its own.</p>
<p>&#8221;We&#8217;re not criminalizing her talking on the phone. That&#8217;s just the reason why&#8221; Dion was distracted, McGinnis said. Even if Dion wasn&#8217;t on the phone at the moment of the crash, her calls during the drive &#8211; with a friend and her son &#8211; were &#8221;back-and-forth&#8221; conversations that influenced her state of mind during the incident, McGinnis said.</p>
<p>In their questions to the attorneys, the justices focused on what constitutes blameworthy conduct &#8211; and who should make that decision.</p>
<p>&#8221;Isn&#8217;t this the kind of thing that&#8217;s in the realm of the jury?&#8221; Justice Robert Lynn asked Ambrose, who said the Legislature, not prosecutors, should decide whether talking on a cell phone while driving is illegal.</p>
<p>Given the familiarity jurors have with the situation, &#8221;they&#8217;re going to be sensitive to it,&#8221; Lynn said. &#8221;Don&#8217;t we all do this every day?&#8221;</p>
<p>At the same time, &#8221;I think all of us are dissatisfied with the driver&#8221; talking on a cell phone, said Justice Gary Hicks, as he cited concern &#8221;this case was queued up to deal with that juror prejudice.&#8221; McGinnis dismissed that assertion &#8211; because cell phone use is so prevalent, she said.</p>
<p>Justice Carol Ann Conboy asked about the difference between a driver distracted by a cell phone instead of a screaming child or a bee trapped in the car.</p>
<p>&#8221;I&#8217;m trying to find that spot that divides civil from criminal liability,&#8221; Conboy told McGinnis. If a driver was distracted by a bee, &#8221;I take it from your argument a responsible driver would say, &#8216;I&#8217;m not going to turn the key on,&#8217; &#8221; Conboy said. &#8221;Is that realistic?&#8221;</p>
<p>Later, when the students in the auditorium had an opportunity to question the attorneys, one raised a similar point. &#8221;Are we just not supposed to drive if we have anything else on our mind besides driving?&#8221; the student asked.</p>
<p>&#8221;The answer is, you can&#8217;t be distracted enough that you can&#8217;t safely drive,&#8221; McGinnis said. She told the students that &#8221;if you can do it safely under the conditions, that&#8217;s fine. If you can&#8217;t, you shouldn&#8217;t be doing it.&#8221;</p>
<p>The justices will decide at a later date whether to uphold the negligent homicide conviction or send the case back to the trial court. Dion, who was sentenced last year to 1« to 3 years in prison, has been allowed to remain free while her appeal is pending.</p>

<p>The state Supreme Court will decide whether talking on a cell phone while driving can justify a conviction of criminally negligent homicide, even though the practice is legal in the state.</p>
<p>Forty-eight-year-old Lynn Dion of Franklin has been convicted of negligent homicide for hitting 36-year-old Genny Bassett in a crosswalk. The prosecutor convinced jurors that Dion was distracted by cell phone conversations.</p>
<p>Dion is appealing. Her lawyer argues that because talking on a cell phone is legal, it can&#8217;t be grounds for conviction.</p>
<p>The state counters that conduct need not be illegal to be criminally negligent.</p>
<p>The case marks the first time the court addresses cell phone use in such a context. Arguments will be heard Oct. 17 at Monadnock Regional High School.</p>

<p>MEREDITH — Faced with a growing demographic imbalance that poses a long-term threat to the Lakes Region&#8217;s economy, the Belknap County Economic Development Council has developed a new strategic plan designed to deal with the issues posed by an aging area population.</p>
<p>The plan focuses on three goals: balancing the county’s demographic make-up, strengthening the region’s &#8220;creative&#8221; economy, and enhancing workforce development programming in the Lakes Region.</p>
<p>“The plan is focused on making our region more attractive to younger, talented workers and creative entrepreneurs,” said outgoing BCEDC Chairman David Haley at the organization&#8217;s annual meeting held at Church Landing last night.</p>
<p>He said “A lot of people know that the Lakes Region is a great place to retire, but most people don’t realize that there will be a wealth of opportunities here for young people over the next decade. We need to get the word out and demonstrate all that this region has to offer to talented workers and entrepreneurs looking for opportunities.”</p>
<p>Carmen Lorentz, BCEDC&#8217;s executive director, said &#8221;It&#8217;s pretty simple. Either we recruit younger people to live and work in Belknap County or our community is going to be dramatically different in 20 years, and not necessarily in a good way. If we don&#8217;t address our demographic imbalance now we will lose key industries and jobs and that will make it even harder for use to offer a sustainable economic and social environment for local residents.&#8221;</p>
<p>She cited a number of troubling trends for the area, including:</p>
<p>— The median age in the Lakes Region is 45.2 (vs. 41.1 for the state). By 2030, 36-percent of Belknap County residents will be over the age of 65. Belknap County also has the highest proportion of seniors living in poverty in the state.</p>
<p>— One-third of all jobs in Belknap County fall into the retail and accommodation and food service categories. Average weekly wages in those sectors are only $510 and $350, respectively, and these jobs tend to have relatively few benefits. This contributes to the fact that only 77-percent of adults in the Lakes Region have health insurance coverage vs. 89-percent statewide.</p>
<p>She said that if these two issues are not addressed, local health care providers will continue to shoulder the burden of low reimbursement rates for Medicaid patients, which puts the long-term viability of the local health care industry at risk. Lorentz noted that the health care sector provides 13-percent of employment in Belknap County and these are some of the best-paying jobs in the region.</p>
<p>Lorentz said that advanced manufacturing is another critical segment of the local economy that is at risk. Although the Lakes Region has been losing manufacturing for decades, the manufacturers that still operate here use high technology to produce precision-machined components that cannot be outsourced.</p>
<p>She said these companies are strong and growing, but they struggle to fill open positions. Entry level positions in advanced manufacturing require strong math, computer, and blueprint comprehension skills, but the region does not produce enough young workers with these skills to meet employer demand. Unless things change, it will become even more and more difficult for the advanced manufacturing sector to remain competitive, which puts 2,300 good paying jobs in Belknap County at risk.</p>
<p>In order to counter these trends, the council plans to launch a business attraction campaign designed to identify what makes the area attractive to young professionals and conduct a campaign targeting at least 20 small creative/professional businesses and reach out to them in an effort to convince them to relocate to the area.</p>
<p>It will also look towards attracting creative entrepreneur and arts and cultural initiatives to the area by creating a partnership which will provide technical assistance, financial management and physical space for start-up businesses.</p>
<p>Plans to enhance workforce development are focused on two areas, and involve growing and enhancing nursing and advanced manufacturing offerings at Lakes Region Community College.</p>
<p>Lorentz also discussed a project called the 200 x 2020 initiative which in addition to BCEDC involves the Lakes Region Chamber of Commerce, Lakes Region United Way, Huot Technical Center, Lakes Region Community College, NH Works and the Laconia Shared Youth Vision.</p>
<p>The initiative seeks to create internships for 200 students in local businesses by the year 2020 which would create meaningful opportunities for students to experience the work world to inspire them to pursue a course of study that will prepare them for life after graduation, whether they are headed to work or to college.</p>
<p>Three major awards were presented at the annual meeting.</p>
<p>— The Corporate Soul Award for commitment to the essence of community went to the WLNH Children&#8217;s Auction.</p>
<p>— The Norman Marsh Award which honors an individual who works daily for the benefit of the residents of the region was presented to attorney Rodney Dyer, a former Laconia mayor and school board chairman.</p>
<p>— The Director&#8217;s Award, which goes to a business, individual or organization for its contributions to the economic vitality of Belknap County was presented to the Laconia School District. for being in the vanguard of community collaboration through is Full-Service Community School Initiative.</p>
<p>Outgoing chairman Haley was presented with a token of recognition for his service by the council&#8217;s new chair, Sean Sullivan. Other officers are Henry Lipman, vice chair; John Giere, secretary and Rick Wyman, treasurer.</p>

			<content:encoded><![CDATA[<p><img class="alignright  wp-image-105" title="Camie_Bailey" src="http://www.wdfnlawyers.com/wp-content/uploads/2012/02/Camie_Bailey-620x463.jpg" alt="" width="250" height="186" />Wescott, Dyer, Fitzgerald &amp; Nichols, PA continued its annual tradition of hosting the New Hampshire Bar Association Lawline on August 12.  Seven WDFN attorneys assisted 67 callers with a variety of legal questions including: landlord/tenant law, criminal defense, family law, collections, employment, personal injury, real estate and tax matters.  Many thanks to our receptionist Camie Bailey (pictured below), who once again did an outstanding job fielding calls.  At 6:00 all nine phone lines lit up simultaneously, and the calls were nonstop until 8:00.</p>
<p>Attorneys Bob Hemeon, Peter Millham, Paul Fitzgerald (pictured below at right), Dorcas Gordon, Rod Dyer (pictured below at left), John Giere, and Catherine Broderick volunteered for the Lawline this year.  A good time was had by all, and we hope our advice helped a few people in need.</p>
